1. Scope and provider
These Terms of Service govern your use of the online service "Liebling" (the "Service"), provided by MOMI Beteiligungs und Beratungs GmbH, Gustav-Kirchhoff-Straße 13, 67098 Bad Dürkheim, Germany ("we", "us", "Provider"). Your contractual counterpart is the Provider only.
2. Description of the service
Liebling is a cloud-based service that lets families privately collect, organise and optionally share via link photos, stories, milestones and growth data of their children. The current feature scope is described on liebling.io/en/pricing.
3. Conclusion of contract
A contract is concluded when you create an account. Paid subscriptions are concluded by selecting a plan and confirming the order during checkout. You must be of legal age or have your legal guardian's consent.
4. User obligations and prohibited use
- You provide accurate registration data and keep it up to date.
- You are responsible for keeping your credentials confidential.
- You must not use the Service for unlawful purposes, in particular not to distribute infringing, harmful or offensive content.
- You must not interfere with or attack the Service (e.g. automated scraping, malware, unauthorised penetration testing).
- You warrant that you hold all necessary rights to the content you upload and respect the personality rights of any persons depicted.
5. User content and license
All content you upload (photos, text, etc.) remains your property. You merely grant us a non-exclusive, time-limited license to store, technically process and — only where you initiate it — make this content available via share links, for the sole purpose of providing the Service.
6. Pricing, payment and renewal
Current prices are available at liebling.io/en/pricing. All prices include applicable VAT. Subscriptions auto-renew for the selected period (monthly or yearly) unless cancelled before the end of the current period.
Orders are processed by our payment provider and Merchant of Record:
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
You can manage your subscription at any time through Paddle's customer portal (paddle.net) or in the app's settings.
7. Withdrawal and refunds
Consumers have a statutory 14-day right of withdrawal. In addition we offer a voluntary 30-day money-back guarantee. Details are described in our Refund Policy.
8. Availability
We aim for high availability but do not guarantee uninterrupted or error-free operation. Maintenance and outages at upstream providers may cause interruptions.
9. Intellectual property
Software, design, trademarks and any other rights in the Service belong exclusively to us or our licensors. Any use beyond the contract — in particular reverse engineering, resale or circumvention of technical limitations — is prohibited.
10. Liability
We are liable without limitation for intent and gross negligence as well as under the German Product Liability Act and for injury to life, body or health. In cases of ordinary negligence we are liable only for the breach of material contractual obligations ("cardinal duties"), capped at typically foreseeable damages. Liability for indirect damages and lost profits is excluded in cases of ordinary negligence.
11. Termination and suspension
You can delete your account at any time. We may terminate the contract for good cause or suspend accounts, in particular for material breaches of these terms, payment default or suspicion of fraud or security risk.
12. Changes to these terms
We may amend these terms for the future. We will announce material changes by email at least six weeks before they take effect. If you do not object within that period, the changes are deemed accepted; if you object, the contract ends on the date the changes would have taken effect.
13. Final provisions
German law applies, excluding the UN Sales Convention. The place of jurisdiction for merchants and legal entities of public law is Bad Dürkheim. Should any provision be invalid, the remainder of the contract remains valid.
